Program Head Terms
1. Introduction
Welcome to ChamberChamps, a product of Araceli Media ("we," "us," or "our"). These terms and conditions ("Terms") govern the use of our software ("Software") by the business association ("Association"). By purchasing and using our Software, the Association agrees to comply with and be bound by these Terms.
2. Acceptance of Terms
By accessing and using the Software, the Association accepts and agrees to these Terms. If the Association does not agree to these Terms, it must not use the Software.
3. Software License
We grant the Association a non-exclusive, non-transferable license to use the Software solely for its marketed and intended purposes. Any use outside of this scope that can be construed as malicious is strictly prohibited.
4. Payment Terms
The Association agrees to pay the fees specified in the purchase agreement, which includes a one-time setup fee and a monthly subscription. The one-time payment is due first, followed by monthly subscription payments. If payments are 30 days late, we will suspend services until the account is current.
5. Data Privacy and Security
We have access to the Association's data for remarketing efforts by Araceli Media. We do not sell or share the Association's data with third parties. We comply with the latest data protection laws and are committed to protecting the data of our businesses and organizers.
6. Support and Maintenance
We offer email support, live chat, and phone support. Each organizer will have an account manager's phone number. Response times may vary.
7. Termination
We reserve the right to suspend services if the Association operates unethically or breaches these Terms. The Association can cancel the agreement with a 30-day notice. Upon termination, we retain the data and can provide necessary information back to the Association, but access to the Software will be revoked.
8. Limitation of Liability
We limit our liability to the maximum extent permitted by law. We are not liable for any damages that arise from the use or inability to use the Software.
9. Governing Law
These Terms are governed by the laws of Ohio.
10. Amendments
We may amend these Terms by providing written notice to the Association. It is the Association's responsibility to share these changes with its users.
